The SEC order finds that Malvern violated antifraud, reporting, books and records, and internal accounting controls provisions of the securities laws for repeatedly failing to timely recognize and account for impairment issues with respect to several large commercial real estate loans. The SEC order finds that Gangemi caused Malvern’s violations. Pursuant to the settlements, Malvern agreed to pay a penalty of $350,000, and Gangemi agreed to pay a penalty of $40,000."
