Defendants Apogee Technology, Inc. ("Apogee"), a publicly traded company based in
Massachusetts, David B. Meyers('Meyers'), Apogee's former Chief Operating Officer, and
Annette Ben-Menachem, who uses the name Annette Jaynes for business purposes ("Jaynes'),
