The Commission stated: "Catch-83 is a general partnership controlled by defendant Gault . . . Gault sufficiently satisfied the judgment against himself such that there is now no relief effectively to be sought against Catch-83 at this time . . . Because Gault's appeal of this Court's judgment is still pending, however, the SEC believes it is premature to dismiss this case against Relief Defendant Catch-83. Should the Court's judgment be vacated on appeal and remanded by the Ninth Circuit for additional proceedings, such as a new trial, it is possible that the SEC would then need to seek relief against Catch-83." On September 24, 2018, the the Ninth Circuit affirmed the judgment against Willie James Gault, see doc. court_doc463_11-cv-01962.
